1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Mini and any related websites, applications, services, features, and content provided by DailyQZ, LLC ("DailyQZ," "we," "us," or "our").
By accessing or using Mini, you agree to be bound by these Terms. If you do not agree, do not use Mini.
Mini is for adults aged 18 and over.
2. Changes to the Service and Terms
We may modify these Terms or any aspect of Mini at any time.
We may add, remove, suspend, discontinue, restrict, or modify features, content, functionality, or services without liability.
Continued use of Mini after updated Terms become effective constitutes acceptance of the revised Terms.
3. Your Content
What you record in Mini is kept on your own device. Our Privacy Policy sets out the specific features that send anything anywhere, and each is off until you turn it on.
"Your Content" means material you send to us through Mini: the feedback you choose to submit from Profile, and the contents of a generative AI request if you switch that feature on.
You retain ownership of Your Content.
Feedback
Any suggestions, ideas, improvements, recommendations, comments, or feedback you provide may be used by DailyQZ without restriction or compensation.
4. Artificial Intelligence and Generated Content
Mini may use automated systems, artificial intelligence, machine learning systems, or similar technologies.
Generated content may be inaccurate, incomplete, outdated, or incorrect.
You are responsible for evaluating any content before relying on it.
5. Acceptable Use
You agree not to:
- Violate applicable laws.
- Infringe intellectual property rights.
- Upload malicious code.
- Interfere with service operation.
- Attempt unauthorized access.
- Use automated systems to access the service except as expressly permitted.
- Impersonate any person or entity.
6. Intellectual Property
Except for Your Content, Mini and all associated software, designs, trademarks, branding, interfaces, databases, systems, and content are owned by DailyQZ or its licensors.
No ownership rights are transferred to you.
7. Third-Party Services
Mini may integrate with or link to third-party services.
We do not control third-party services and are not responsible for their content, actions, availability, policies, or practices.
Your use of third-party services is governed by their terms.
8. Termination
We may modify or discontinue Mini at any time.
You may stop using Mini at any time.
Sections intended to survive termination will survive termination.
9. Disclaimers
MINI IS PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYQZ DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY
- AVAILABILITY
- SECURITY
- RELIABILITY
WE DO NOT GUARANTEE THAT MINI WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYQZ, ITS AFFILIATES, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO MINI SHALL NOT EXCEED THE GREATER OF:
- ONE HUNDRED U.S. DOLLARS ($100), OR
- THE AMOUNT YOU PAID TO DAILYQZ DURING THE TWELVE MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless DailyQZ, its affiliates, officers, managers, members, employees, contractors, licensors, service providers, and partners from any claims, damages, liabilities, losses, costs, expenses, and attorneys' fees arising from:
- Your use of Mini.
- Your Content.
- Your violation of these Terms.
- Your violation of any law or third-party rights.
12. Dispute Resolution and Arbitration
To the fullest extent permitted by law, any dispute arising from or relating to these Terms or Mini shall be resolved through binding individual arbitration.
You and DailyQZ waive any right to participate in a class action, class arbitration, or representative proceeding.
If a court determines that this class-action waiver is unenforceable, this arbitration provision shall be unenforceable only to that extent.
Nothing prevents either party from seeking injunctive relief relating to intellectual-property rights.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
14. Assignment
DailyQZ may assign or transfer these Terms and any associated rights or obligations without restriction.
You may not assign your rights without our prior written consent.
15. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in full force and effect.
